Pre-Order Conditions

Please read these Pre-Order Conditions ("Terms") carefully before placing a pre-order on our website. By placing a pre-order, you agree to be bound by these Terms as well as our general Terms of Service and Privacy Policy.

1. Merchant Entity & Scope

All pre-order transactions, order fulfillment, and billing on this website are processed and operated by: Evolia AI Pty. Ltd. (ABN: 90 699 391 538 / ACN: 699 391 538), Registered Address: 2 Governors Way, Oatlands NSW 2117, Australia.

Evolia AI Pty. Ltd. is a wholly-owned subsidiary of Evolia AI Pte. Ltd. (Singapore). Unless expressly stated in the order confirmation, the Singapore parent company is not the seller or a contracting party. Evolia AI Pty. Ltd. remains fully responsible for the sale.

2. Product & Limited Availability

The pre-order applies to the Evolia Founders Edition (available in three color options). The Founders Edition is strictly limited to 1,000 pieces worldwide across all colors.

• A pre-order reserves availability but does not guarantee a specific production serial number, delivery sequence, or exact color appearance.
• Product images are illustrative. Minor natural or production variations may occur. If any material change is made prior to final payment, we will notify you and provide a right to cancel for a full refund.

3. Product Pricing & Supported Currencies

4. Deposit Requirement & Payment Settlement

• Universal Deposit: A deposit of USD $99.00 is required at the time of placing your pre-order to reserve your item.
• Currency Settlement: All deposits are charged and settled exclusively in United States Dollars (USD $99), regardless of your location. Your payment provider may apply currency conversion rates or fees.
• Final Balance: The remaining balance (product price minus deposit equivalent, plus shipping and applicable taxes) will be billed prior to shipment.

5. Shipping Destinations & Eligible Regions

Pre-orders are strictly available for delivery to addresses located within: United Kingdom, European Union (Member States), Australia, Singapore, New Zealand, United States, Canada, Japan, South Korea, and Hong Kong SAR.

6. Estimated Delivery Schedule

• Shipping Timeline: Dispatch is estimated to begin from late October 2026. This is an estimate and not a guaranteed delivery date.
• Allocation: Orders will be fulfilled on a first-paid, first-served basis according to the deposit payment sequence.

7. Final Payment Notice & 7-Day Window

When your order is ready for final payment and shipment, we will send a Final Payment Notice to your registered email address.

• You will have seven (7) calendar days from the notice date to pay the remaining balance or cancel your pre-order.
• If you neither pay the balance nor cancel within this 7-day period, we reserve the right to cancel your reservation and retain the deposit as a reasonable administration fee, to the extent permitted by applicable law.

8. Pre-Order Cancellation & Deposit Refunds

• Customer Cancellation: You may cancel your pre-order and receive a full refund of your USD $99 deposit at any time before the Final Payment Notice is issued, or within the 7 calendar days following the notice. Cancellation requests should be sent to hello@evolia.com.
• Merchant Cancellation: If we cancel the pre-order due to inventory constraints, pricing errors, or inability to fulfill, your deposit will be refunded in full.

9. Founders Edition Exclusive Benefits

• Lifetime Limited Warranty: We provide the original purchaser with a lifetime limited warranty against manufacturing defects in materials and workmanship for the Founders Edition hardware under normal use. (Does not cover normal wear, cosmetic aging, accidental damage, or unauthorized modifications).
• Included 18-Month Hardware Upgrade: The original purchaser is eligible for one (1) included hardware upgrade beginning 18 months after initial delivery (must be claimed within the following 6 months). The upgrade hardware module itself is provided at no extra charge (shipping/taxes may apply where permitted).

10. Statutory & Mandatory Consumer Rights

Nothing in these Terms excludes or limits statutory rights that cannot be lawfully excluded under local laws (including Australian Consumer Law, UK/EU 14-day distance selling withdrawal rights, US FTC rules, and local consumer protections in South Korea, Singapore, Japan, etc.). Mandatory local laws shall prevail.
